The invalidity pension is paid by Social Security to private sector employees who can no longer exercise an activity due to an accident or a non-occupational disease, and who therefore see their income from work drop. This pension compensates for this loss of salary. The self-employed and civil servants can also benefit from this monthly financial aid, under slightly different conditions.
The invalidity pension concerns people considered invalid, i.e. whose working capacity is reduced by at least two-thirds following an accident or illness of non-occupational origin. , resulting in a decline in their work-related income. In other words, whose inability to work results in not being able to benefit from a salary higher than one third of a reference remuneration which corresponds to that of workers in the same category and in the same geographical area ( region).
In addition to being considered disabled, to be able to receive a disability pension, you must have been registered with Social Security for at least twelve months from the 1 st day of the month of work stoppage followed by disability or recognition of disability.
The invalidity pension can also be paid on the condition of justifying a period of social security contribution, or having contributed on the basis of remuneration at least equal to 2,030 times the hourly minimum wage during the 12 calendar months. preceding the work stoppage. On the other hand, it is also necessary to have worked at least 600 hours during the 12 months preceding the interruption of work or the finding of the state of disability.
A person receiving a disability pension benefits from 100% reimbursement of their medical care, examinations and certain medications within the limits of the rates set by Social Security.
If he continues to carry out a professional activity despite his disability, the recipient of a disability pension may benefit from daily allowances in the event of sick leave (except the self-employed), maternity leave, paternity or adoption, subject to fulfilling the conditions for the opening of these rights.
On the other hand, a person who receives a disability pension and who can continue to work is entitled to an employment obligation certificate for disabled workers (OETH), valid for 5 years.
Finally, subject to fulfilling the conditions for granting it, a disability pension gives the right to hold a mobility inclusion card intended to facilitate daily life, particularly in terms of travel.
People considered disabled are classified into three categories by the social security medical adviser, categories that allow the amount of the disability pension to be calculated. The calculation of the latter, which is paid monthly, also takes into account the average annual salary of the disabled person, determined according to their ten best years of salary.
It should be noted that the amount of the invalidity pension, which is reassessed at national level on 1 st April of each year, may increase, decrease or be eliminated depending on the evolution of the beneficiary's state of health or if he resumes a professional activity. At the time of retirement, the invalidity pension is transformed, depending on the case, into a retirement pension for incapacity or is paid up to the age of 67.
The disability pension is subject to income tax, the general social contribution (CSG), the contribution to the repayment of social debt (CRDS), as well as the additional solidarity contribution for autonomy. (Casa).
The 1 re category includes disabled persons capable of carrying out a remunerated activity. Their invalidity pension corresponds to 30% of their average annual salary. It is a minimum of 293 euros per month and a maximum of 1,030 euros.
The 2 th category includes invalids who are absolutely unable to exercise a profession. The invalidity pension is equivalent to 50% of their average annual salary, within a range of 293 euros monthly minimum to 1714 euros maximum.
The 3 th category includes invalids of the 2 th category but who, in addition, are obliged to have recourse to the assistance of a third person to carry out the ordinary acts of life. The amount of the invalidity pension is then a minimum of 1,400 euros per month and a maximum of 2,800 euros. Unlike the other categories, it includes an increase for a third party of approximately 1,130 euros and which is not subject to any deduction or taxation.
The self-employed are subject to slightly different treatment, the details of which are available on the ameli.fr website. Civil servants can benefit from the temporary disability allowance (AIT).
There are two scenarios for receiving a disability pension.
Provided that you meet the conditions for receiving a disability pension given your situation, the CPAM can inform you directly by registered letter with acknowledgment of receipt of the possibility of paying you this pension, within two months following its decision to place you on invalidity.

In this case, she must send the invalidity pension application form accompanied by a certain number of documents (latest income tax notice, identity document, notification of pension for accident at work or occupational disease, notification of the payment of another invalidity pension paid by a scheme other than the general scheme, or notification of the payment of a military pension for illness, war injury or as a civilian victim of the war).
The request for a disability pension must be sent to the CPAM no later than 12 months following the permanent observation of the injury occurring during an accident or illness of non-occupational origin, the medical observation disability, the stabilization of the state of health of the person concerned, the expiry of the legal period for granting daily allowances (3 years maximum), or the date on which the CPAM ceases to pay the allowances daily allowances for sickness.
The CPAM has two months to respond, positively or negatively, to an individual request for a disability pension. Without a response beyond this deadline, the request for pension is considered refused.
